This Online-Only Auction has a soft-staggered close; an additional five minutes is added to the close time for every 30 lots being offered (i.e. lots 1-30 begin to close at 6:00pm, lots 31-60 begin to close at 6:05pm, etc.). If any bids are received within the five minutes prior to a lot closing, the lot time will be extended for an additional five minutes (i.e. lot 1 receives a bid at 5:56pm, the time extends to 6:01pm). The five minute extension will continue to be applied until no further bids have been placed.

When placing a bid, you are welcome to bid the asking price, or you may enter your maximum bid and the system will competitively execute your bid for you.

Terms & Conditions
IMPORTANCE OF TERMS
Please take the time to read the following set of terms and conditions for the auction. By obtaining a Bidder Number, you acknowledge that you have read and agree to these terms and conditions.

BIDDER RESPONSIBILITIES
Bidder is responsible for any and all activity, bids, and purchases involving Bidder's account. Bidder is responsible for reviewing and complying with all laws relating to the purchase of alcohol in their registered state. Once a bid has been placed, it cannot be lowered or deleted. Bidder agrees to keep its username and password confidential.

CONDITIONS
Leland Little Auctions, Ltd. has endeavored to accurately describe the items being sold, but all property offered for sale is strictly "as - is" "where - is" with all faults. All sales are final and no refunds are given. The sales records and recordings shall be conclusive. It is the bidder's responsibility to determine the exact condition/authenticity of each item. No statement in this catalogue or by representatives of LLA, Ltd. shall be considered as a warranty or assumption of liability. Written and oral descriptions given by LLA, Ltd. staff members are given as a courtesy to a client, are only an opinion, and should not be considered as a guarantee of age, composition, or authenticity. The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear or imperfections. High resolution images are provided to assist a bidder in making an additional assessment of condition. By bidding, you signify that you have either closely examined the items, have chosen not to examine them, or have hired an independent agent to examine the item(s) for you. Condition reports are available via the online catalog or by contacting the LLA, Ltd. office. BUYER'S PREMIUM
Bidding is available by online absentee bidding on LelandLittle.com with an 18% buyer's premium.

PAYMENT
All items purchased via absentee bidding must be paid for upon receipt of invoice and within five business days of sale date. Payment can be made by cash, approved certified funds, wire transfer, approved check, PayPal, Visa or MasterCard with a domestic U.S. billing address. If a buyer fails to contact LLA, Ltd. within five (5) business days following the sale, the credit card used to secure the bid will be charged the amount of the invoice. If paying by check, LLA, Ltd. reserves the right to hold the item(s) until the check has cleared. Federal law requires we report payments above $10,000 made by cash or certain other cash equivalents, such as money orders. Credit card payments are subject to a $5,000 limit. International (non-domestic United States) bidders will be required to pay by wire transfer. Wire transfer fees will be incurred by the buyer. At the auctioneer's discretion, certain lots will be required to be paid for by wire transfer. North Carolina sales tax is 7.5%.

AUCTIONEER
Leland J. Little, NCAL#6139; NCFL#7452. The auctioneer always reserves the right to withdraw a lot for any reason he deems appropriate, including any lots that may have a reserve, or if there is a lack of bidding interest or lack of appropriate bids. LLA, Ltd. shall have the right to withdraw any item at any time for any reason and to default any sale in the event of an error or dispute.

ONLINE ABSENTEE BIDDING
Online absentee bidding is available during the auction. LLA cannot be held liable for Internet bids that are not sent or received by the server. The Online-Only Auction has a soft-staggered close; an additional five minutes is added to the close time for every 30 lots being offered. Any lot that receives a bid five minutes or less prior to its ending time will have its online absentee bidding time extended for an additional five minute period from the point of the last bid. Any and all lots will close either at the designated closing time or at such point that it has not received an advanced bid within a five minute time frame.

OWNERSHIP
Item ownership is conveyed immediately following the fall of the Auctioneer's hammer. While we try to handle and store items with great care, LLA, Ltd. will have no liability for any loss or damage to an item after the hammer has fallen. LLA, Ltd. is not liable for any damages incurred if assistance with loading is requested. Buyers are welcome to hire a professional shipping or moving company to assist with loading, packing, or shipping.

LOADING
Loading purchased items is the responsibility of the buyer. LLA, Ltd. will, as a courtesy, assist with the loading following the sale, but this is done at the risk and responsibility of the buyer. Buyers who wish to arrange their own labor may contact the front office to schedule a time during normal business hours. LLA, Ltd. will have no liability for any damage while providing loading assistance.

ABANDONED PROPERTY
Unless prior arrangements have been made, any lot(s) remaining at the LLA, Ltd. auction gallery more than 90 calendar days after the auction purchase date will be considered abandoned and no refunds will be given.  LLA, Ltd. is not obligated to notify the winning bidder of the abandoned lot(s).

STORAGE
Unless prior arrangements are made, pick-up within 30 working days of the auction is requested. Wine may be stored short-term free-of-charge in climate-controlled conditions for later shipment during cooler temperatures.

SHIPPING & PICK UP
The LLA, Ltd. Wine Department is pleased to assist with the Third Party Shipping of domestic and international purchases. The Third Party Shippers follow all shipper guidelines and applicable state laws. All shipments are shipped with their declared value and full insurance per the carrier's terms and conditions. All wine invoice shipments are shipped with a declared value and insurance not to exceed $10,000 per box or $50,000 per shipment, per the carrier’s terms and conditions. A signature is required for delivery.

LLA, Ltd. does not automatically make third party arrangements to ship wine. To request shipping, please complete and submit the Wine Release Form available online. We respond to requests in the order received. Quotes are valid for fifteen days. Shipping may take several weeks from the time of initial contact.

Please note that for all shipments any and all additional charges, including but not limited to customs charges, are the sole responsibility of the buyer. If you reside in a state or country that has import restrictions or regulations, it is your responsibility to obtain appropriate licenses to ship your wine.

If shipping wine, buyer warrants that he/she is at least 21 years of age. Buyer shall be responsible for the shipment of these wines to be received and signed for by an adult at least 21 years of age.

By requesting Third Party Shipping arrangements you are giving the Auctioneers permission to charge your provided Visa or MasterCard for said charges. All packing, handling, shipping, and delivery services are performed at the sole risk of the buyer. The Auctioneers assume no legal or financial responsibility and is free from all liability associated with assisting with your shipping request.

When arranging shipping or pick up through another vendor or third-party of your choice, we require that you complete our Authorized Release Form. This form authorizes us to release your purchased items to the requested party. We will not release your lot(s) to any shipping vendor or third-party until we have received this form and payment has been made in full.

Please note that shipment or pick up is the sole responsibility of the buyer. If you reside in a state or country that has import restrictions or regulations, it is your responsibility to obtain appropriate licenses to ship your purchased items (see the restricted materials section for more detail).

All packing, handling, shipping, and delivery services are performed at the sole risk of the buyer. LLA, Ltd. assumes no legal or financial responsibility and is free from all liability associated with fulfilling your release request.

DISPUTES
Any and all disputes resulting or arising in connection with this auction shall be heard in the General Court of Justice of Orange County, North Carolina as the sole and exclusive venue.

LEGAL INTERPRETATIONS
This document will be interpreted by the laws of the State of North Carolina and by the United States Code.
